FELONY ARREST IN THE TOWN OF AVON

On April 7th, 2026 at approximately 2:28 pm, Sheriff’s Deputies were dispatched to a business in the Town of Geneseo for the larceny of merchandise. It was also reported that the suspect had left the location in a vehicle. Deputy Dylan Bowser located the suspect vehicle on Interstate 390 in the Town of Avon and conducted a traffic stop on the vehicle. Contact was made with the operator of the vehicle, who was identified as 34-year-old Austin McMurry of Rochester. McMurry was found to be in possession of the stolen merchandise and was also found to be in possession of an un-registered handgun and did not have a NYS Pistol Permit.
McMurry was arrested and charged with felony Criminal Possession of a Firearm, felony Criminal Possession of a Weapon in the Second Degree and Petit Larceny.
McMurry was transported and turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention. McMurry was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Springwater Justice Johnson. The Judge did release McMurry on his own recognizance as the charges do not qualify for bail under the NYS Bail Reform Act.
The Livingston County Public Defender’s Office was present and represented McMurry at the court arraignment for his defense. The Livingston County District Attorney’s Office was also present to represent the People.Â
Assisting with the investigation for the Sheriff’s Office was members of the Patrol Division, Criminal Investigations Division and the Forensic Identification Unit.
