FELONY ARREST IN THE TOWN OF AVON

AVON - Sheriff Thomas J. Dougherty reports the arrest of a Livonia resident on felony Driving While Intoxicated charges following an investigation by the Livingston County Sheriff’s Office.

On October 8th, 2026 at approximately 6:48 pm, Sheriff’s Deputies were dispatched to Bronson Hill Road in the Town of Avon for the reported motor vehicle crash. 

Deputies arrived on scene and made contact with the operator of the vehicle who was identified as 39-year-old Brandon Horrocks of Livonia.  During the initial encounter with Horrocks, the Deputies suspected that he was possibly under the influence of alcohol.  Deputy Caleb Nellis, of the Sheriff’s STOP DWI Unit conducted a DWI investigation which included the performance of standardized field sobriety tests.  At the completion of the roadside investigation, Horrocks was taken into custody for DWI.

Horrocks was transported to the Sheriff’s Office Headquarters in Geneseo, where he was offered a breathalyzer to determine his blood alcohol content (BAC).  Sergeant Kyler Stone of the Jail Division did administer the test, which revealed that Horrocks had a blood alcohol content (BAC) of .09%.

A records check revealed that Horrocks had a previous DWI related conviction in 2025, making this arrest a felony.

Horrocks was charged with felony Driving While Intoxicated and multiple violations of the NYS Vehicle & Traffic Law. Horrocks was turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention.  He was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of West Sparta Justice Mahany.  The Judge did release Horrocks on his own recognizance, as the offenses do not qualify for bail under the NYS Bail Reform Act.The Livingston County Public Defender’s Office was present and represented Horrocks at the court arraignment for his defense. The Livingston County District Attorney’s Office was notified and also appeared to represent the People.
