FELONY ARREST IN THE TOWN OF YORK

On May 1st, 2026 at approximately 7:15 pm, Sheriff’s Deputy Jacob Cicero was assigned to the Sheriff’s Office STOP DWI Unit when he conducted a traffic stop on Main Street in the Town of York after observing a violation of the NYS Vehicle and Traffic Law. Contact was made with the operator, who was identified as 30-year-old Cody Greene of Wyoming, NY.Â
During the initial encounter with Greene, the Deputy suspected that he was possibly under the influence of alcohol. A DWI investigation was conducted, which included the performance of standardized field sobriety tests. At the completion of the investigation, Greene was taken into custody for DWI.
Greene was transported to the Sheriff’s Headquarters in Geneseo where Deputy Nicholas Evangelista of the Jail Division administered a breathalyzer test to determine his blood alcohol content (BAC). The breathalyzer revealed that Greene had a blood alcohol content of .36%.
A records check showed that Greene did have a prior conviction for Aggravated DWI in 2021, making this arrest a felony.
Greene was charged with felony Driving While Intoxicated, Aggravated Driving While Intoxicated and violations of the NYS Vehicle and Traffic Law.Greene was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. He was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Caledonia Justice Riggi. The Judge did release Greene on his own recognizance, as the offenses do not qualify for bail under the NYS Bail Reform Act.The Livingston County Public Defender’s Office was present and represented Greene at the court arraignment for his defense. The Livingston County District Attorney’s Office also appeared to represent the People.
