FELONY ARREST IN THE VILLAGE OF GENESEO

GENESEO - Sheriff Thomas J. Dougherty reports the arrest of a Springwater resident on felony charges following an investigation by the Livingston County Sheriff’s Office.

On May 13th, 2026, Sheriff’s Investigators arrested 39-year-old, David Dale for felony Failure to Register and Verify as a New York State Registered Sex Offender. 

It is alleged through the investigation that Dale, who is a level (2) New York State Registered Sex Offender, failed to provide an updated photograph as required by law. It was further discovered that Dale had two previous convictions for Failure to Register and Verify as a Sex Offender in New York State, which makes this a Class D Felony.

The NYS Corrections Law section 168-F 2 (b-3) states: If the sex offender has been given a level one or level two designation, he or she shall personally appear at the law enforcement agency having jurisdiction within twenty days of the third anniversary of the sex offender's initial registration and every three years thereafter during the period of registration for the purpose of providing a current photograph of such offender. The law enforcement agency having jurisdiction shall photograph the sex offender and shall promptly forward a copy of such photograph to the division. For purposes of this paragraph, if such sex offender is confined in a state or local correctional facility, the local law enforcement agency having jurisdiction shall be the warden, superintendent, sheriff or other person in charge of the state or local correctional facility.

Dale was located at his residence in Springwater and was taken into custody without incident. Dale was transported to the Livingston County Jail, where he was turned over to Central Booking Deputies for processing and pre-arraignment detention. Dale was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of West Sparta Justice Mahany. The Judge did remand Dale to the custody of the Sheriff without the possibility of bail due to him having two or more prior felony convictions. 

The Livingston County Public Defender’s Office was present and represented Dale at the court arraignment for his defense. The Livingston County District Attorney’s Office was also present to represent the People.
