FELONY ARREST IN THE VILLAGE OF LIVONIA

On April 16th, 2026 at approximately 8:49 pm, Sheriff’s Deputy Jacob Cicero was assigned to the Sheriff’s Office STOP DWI Unit and conducted a traffic stop on Main Street in the Village of Livonia after observing a vehicle violating the NYS Vehicle and Traffic Law.
Contact was made with the operator who was identified as 64-year-old Maria Maggio of Livonia. During the initial encounter with Maggio, the Deputy Sheriff suspected that she was possibly under the influence of alcohol. A DWI investigation, which included standardized field sobriety tests was conducted. At the conclusion of the roadside investigation, Maggio was taken into custody for DWI.
Maggio was then transported to the Sheriff’s Office Headquarters in Geneseo, where she was offered a breathalyzer to determine her blood alcohol content (BAC). Deputy Meghan Waters of the Jail Division did administer the test, which revealed that Maggio had a blood alcohol content (BAC) of .15%.
A records check revealed that Maggio had a previous DWAI related conviction in 2018, making this arrest a felony.
Maggio was charged with felony Driving While Intoxicated and violations of the NYS Vehicle & Traffic Law. Maggio was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. She was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of York Justice Koch. The Judge did release Maggio on her own recognizance, as the offenses do not qualify for bail under the NYS Bail Reform Act.The Livingston County Public Defender’s Office was present and represented Maggio at the court arraignment for her defense. The Livingston County District Attorney’s Office was notified and also appeared to represent the People.
