FELONY ARREST IN THE TOWN OF LIVONIA

LIVONIA - Sheriff Thomas J. Dougherty reports the arrest of a Wyoming County resident on a felony charge following an investigation by the Livingston County Sheriff’s Office.

On August 14^th, 2026, the Sheriff’s Office commenced an investigation into a possible sexual offense that was committed in the Town of Livonia. The Sheriff’s Office Criminal Investigations Division launched an investigation into the allegations. It is alleged through the investigation that 21-year-old, David Summers Jr. from Warsaw, NY had sexually assaulted a 21-year-old female in May of 2026.

On September 15^th, 2026, Sheriff’s Investigators arrested and charged Summers with felony Rape in the Third Degree.

Summers was transported to the Livingston County Jail, where he was turned over to Central Booking Deputies for arrest processing and pre-arraignment detention. Summers was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Conesus Justice Coyne.  The District Attorney’s Office recommended that Summers be held on $5,000 cash bail or $15,000 bond.  The Judge did remand Summers to the custody of the Sheriff on $1,500 cash or $3,000 bond.   

The Livingston County Public Defender’s Office was present and represented Summers at the court arraignment for his defense. The Livingston County District Attorney’s Office was notified and was also present at the court proceeding to represent the People.

The investigation was handled by members of the Sheriff’s Office Criminal Investigations Division and Patrol Division.
