FELONY ARREST IN THE TOWN OF YORK
On September 13th, 2026 at approximately 1:17 am, Sheriff’s Deputy Joshua Batalla conducted a traffic stop on Genesee Street in the Town of York after observing a vehicle violating the NYS Vehicle and Traffic Law.
Contact was made with the operator who was identified as 27-year-old Christopher Castro of Springwater. During the initial encounter with Castro, the Deputy Sheriff suspected that he was possibly under the influence of alcohol. Deputy Caleb Nellis, of the Sheriff’s STOP DWI Unit was requested to the scene to conduct a DWI investigation. At the completion of the roadside investigation, Castro was taken into custody for DWI.
Castro was then transported to the Sheriff’s Office Headquarters in Geneseo, where he was offered a breathalyzer to determine his blood alcohol content (BAC). Castro did ultimately refuse to submit to a chemical breath test.
A records check revealed that Castro was operating the vehicle while having a revoked NYS Driver’s License, making this arrest a Felony.
Castro was arrested and charged with felony Aggravated Unlicensed Operation in the First Degree, misdemeanor Driving While Intoxicated and violations of the NYS Vehicle & Traffic Law. Castro was turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention. He was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Livonia Justice Chichester. The Judge did release Castro on his own recognizance, as the offenses do not qualify for bail under the NYS Bail Reform Act.The Livingston County Public Defender’s Office was present and represented Castro at the court arraignment for his defense. The Livingston County District Attorney’s Office was notified and also appeared to represent the People.
