FELONY ARREST IN THE TOWN OF LIVONIA

LIVONIA - Sheriff Thomas J. Dougherty reports the arrest of a Genesee County resident on felony charges following an investigation by the Livingston County Sheriff’s Office.

On July 22nd, 2026 at approximately 11:30 pm, Deputies assigned to the Hemlock Fair Detail observed a vehicle being operated in an erratic manner while in the parking lot on the fairgrounds.  Deputies were able to conduct a traffic stop on the vehicle and made contact with the operator, who was identified as 20-year-old Heaven D’Augustino of Pavilion NY.  Deputies suspected that D’Augustino was under the influence of alcohol, which prompted a DWI investigation.  Deputy Caleb Nellis, who is assigned to the Sheriff’s Office STOP DWI Unit responded to the scene and conducted the DWI investigation, which included the performance of standardized field sobriety tests.  At the conclusion of the investigation, D’Augustino was taken into custody for DWI. 

D'Augustino did have two teenage children in the vehicle as passengers, making this a felony arrest under Leandra’s Law.

D’Augustino was transported to the Sheriff’s Office Headquarters in Geneseo where she was offered a breathalyzer to determine her blood alcohol content (BAC).  Deputy Hayden Strobel of the Patrol Division did administer the test, which revealed that D’Augustino had a BAC of .12%

D'Augustino was charged with felony Driving While Intoxicated (Leandra’s Law), two counts of misdemeanor Endangering the Welfare of a Child and violations of the NYS Vehicle and Traffic Law.D’Augustino was turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention.  She was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Mt. Morris Justice Finnigan.  The Judge did release D’Augustino on her own recognizance, as the offenses do not qualify for bail under the NYS Bail Reform Act.The Livingston County Public Defender’s Office was present and represented D’Augustino at the court arraignment for her defense. The Livingston County District Attorney’s Office was notified and did also appear to represent the People.
