FELONY ARREST IN THE TOWN OF LIVONIA

On July 24th, 2026 at approximately 8:00 pm, Sheriff’s Deputies responded to the area of Main Street in the Town of Livonia for the reported traffic complaint concerning a vehicle being operated in an erratic manner. While Deputies were in-route, it was reported that the vehicle had crashed into another vehicle and the male operator was outside of the vehicle and appeared to possibly be attempting to conceal evidence.
Deputy Jacob Cicero, of the Sheriff’s Office STOP DWI Unit, arrived on scene and made contact with the male operator who was identified as 37-year-old Jake Winters of Rochester NY. The Deputy suspected that Winters was possibly under the influence of alcohol and conducted a DWI investigation. The investigation included the performance of standardized field sobriety tests. At the conclusion of the roadside investigation, Winters was taken into custody for DWI.
Winters was offered a breathalyzer to determine his blood alcohol content (BAC) and did ultimately refuse to submit to the chemical breath test.
Winters was arrested and charged with felony Tampering with Physical Evidence, misdemeanor Driving While Intoxicated and violations of the NYS Vehicle and Traffic Law.Winters was transported and turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention. He was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Mt. Morris Justice Finnigan. The Judge did remand Winters to the Custody of the Sheriff without the possibility of bail due to a prior felony conviction and a pending un-related felony level investigation.The Livingston County Public Defender’s Office was present and represented Winters at the court arraignment for his defense. The Livingston County District Attorney’s Office was also present to represent the People.
