FELONY ARREST IN THE VILLAGE OF GENESEO

On October 1st, 2026, Sheriff’s Investigators arrested 50-year-old John Wesner for felony Failure to Register and Verify as a New York State Registered Sex Offender.
It is alleged through the investigation that Wesner, who is a level (1) New York State Registered Sex Offender, failed to report to the Livingston County Sheriff’s Office and update his photograph as required by law.
The NYS Corrections Law section 168-F 2 (b-3) states: If the sex offender has been given a level one or level two designation, he or she shall personally appear at the law enforcement agency having jurisdiction within twenty days of the third anniversary of the sex offender's initial registration and every three years thereafter during the period of registration for the purpose of providing a current photograph of such offender. The law enforcement agency having jurisdiction shall photograph the sex offender and shall promptly forward a copy of such photograph to the division. For purposes of this paragraph, if such sex offender is confined in a state or local correctional facility, the local law enforcement agency having jurisdiction shall be the warden, superintendent, sheriff or other person in charge of the state or local correctional facility.
Wesner was arrested and transported to the Livingston County Jail, where he was turned over to Central Booking Deputies for processing and pre-arraignment detention. Wesner was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Caledonia Justice Riggi. The Judge did release Wesner on his own recognizance as the offense does not qualify for bail under the NYS Bail Reform Act.
The Livingston County Public Defender’s Office was present and represented Wesner at the court arraignment for his defense. The Livingston County District Attorney’s Office was present to represent the People.
