FELONY ARREST IN THE TOWN OF AVON

On May 2nd, 2026 at approximately 11:00 pm, Deputy Matt VanCuran was assigned to the Sheriff’s Office Highway Patrol Unit when he conducted a traffic stop on Interstate 390 in the Town of Avon after observing violations of the NYS Vehicle and Traffic Law. The Deputy made contact with the operator, who was identified as 38-year-old Samantha Rodriguez. There was a passenger in the vehicle who was identified as 35-year-old Kyle Rodriguez, also of Springwater.
During the roadside investigation, it was found that there was an Order of Protection in place, protecting Samantha from Kyle and that Samantha was also operating the vehicle while having a suspended NYS Driver’s License. Additionally, Samantha was also found to be in possession of crack cocaine. Both Kyle and Samantha were taken into custody at the completion of the roadside investigation.
Samantha was charged with felony Criminal Possession of a Controlled Substance in the Fifth Degree, Aggravated Unlicensed Operation in the Third Degree and violations of the NYS Vehicle and Traffic Law. Kyle was charged with felony Aggravated Family Offense and misdemeanor Criminal Contempt in the Second Degree.
Both individuals were transported and turned over to Central Booking Deputies at the Livingston County Jail for arrest processing and pre-arraignment detention. Kyle and Samantha were later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Caledonia Justice Riggi. The Judge released Samantha on her own recognizance due to the offenses not qualifying for bail under the NYS Bail Reform Act. The District Attorney’s Office recommended that Kyle be held on $2,000 cash bail or $4,000 bond. The Judge did remand Kyle to the custody of the Sheriff on the recommended bail and bond.
The Livingston County Public Defender’s Office was present and represented both Defendants at the court arraignments for their defense. The Livingston County District Attorney’s Office was also present to represent the People.
