GENESEO - Sheriff Thomas J. Dougherty reports the arrest of a Niagara County resident on felony charges following an investigation by the Livingston County Sheriff’s Office.

On April 30th, 2026 Sheriff’s Investigators arrested 34-year-old, Robert Martinez, for felony Failure to Register and Verify as a New York State Registered Sex Offender. 

It is alleged through the investigation that Martinez, who is a level (1) New York State Registered Sex Offender, failed to provide his change of address as required by law. It was further discovered that Martinez had a previous conviction for Failure to Register and Verify in New York State, which makes this a Class D Felony.

The NYS Corrections Law section 168-F (4) states: Any sex offender shall register with the division no later than ten calendar days after any change of address, internet accounts with internet access providers belonging to such offender, internet identifiers that such offender uses, or his or her status of enrollment, attendance, employment or residence at any institution of higher education.

Martinez was located in the Town of Le Roy and was taken into custody without incident. Martinez was transported to the Livingston County Jail, where he was turned over to Central Booking Deputies for processing and pre-arraignment detention. Martinez was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Caledonia Justice Riggi. The Judge did release Martinez on his own recognizance as the offense did not qualify for bail under the NYS Bail Reform Act.

The Livingston County Public Defender’s Office was present and represented Martinez at the court arraignment for his defense. The Livingston County District Attorney’s Office was present to represent the People.
